2. INTELLECTUAL PROPERTY & OWNERSHIP

All proprietary materials on this Site, including logos, designs, custom code frameworks, branding assets, graphics, software scripts, and text ("Service Content") are owned by or licensed to Pixel Growth Labs.

Your Client Site Content: You retain ownership of all original text, logos, trademarks, and images provided by you for incorporation into your custom website. Upon active client subscription, you are granted a full worldwide license to use and present your customized website.

3. SERVICE TERMS & SUBSCRIPTIONS

• Monthly Plans: Our Services are provided on a monthly subscription model (Starter at $197/mo and Pro at $297/mo unless agreed otherwise in writing).
• No Long-Term Contracts: Subscriptions run month-to-month. You may cancel at any time with 30 days written notice. Upon cancellation, your site files and assets will be exported and transferred to you.
• 30-Day Satisfaction Guarantee: If you are not completely satisfied with your new website within 30 days of launch, we will refund your first month's subscription fee upon request — no questions asked.

4. USER CONDUCT & RESTRICTIONS

When interacting with our Site and Services, you agree not to:

• Use the Services for any unlawful purpose or in violation of federal, state, or local laws.
• Attempt to decompile, reverse engineer, or hack any portion of our core platform or servers.
• Upload or transmit harmful code, malware, spam, or infringing third-party intellectual property.
• Impersonate any person or entity or misrepresent your affiliation with a business.

5. DISCLAIMER OF WARRANTIES

OUR SERVICES AND SITE CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. PIXEL GROWTH LABS DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WHILE WE STRIVE FOR 99.9% UPTIME AND OPTIMAL CONVERSION PERFORMANCE, WE DO NOT GUARANTEE SPECIFIC REVENUE NUMBERS OR UNINTERRUPTED SERVER OPERATION BEYOND OUR STANDARD SERVICE LEVEL AGREEMENTS.

6. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PIXEL GROWTH LABS, ITS OFFICERS, DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SERVICES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO US IN THE PRECEDING THREE (3) MONTHS.

7. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Pixel Growth Labs from and against any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of or related to your breach of these Terms or your misuse of the Services.

8. GOVERNING LAW & JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to its conflict of law principles. Any legal action or dispute arising under these Terms shall be instituted exclusively in the state or federal courts located in Wyoming.
